Inail injury relapse, complete guide

In carrying out their work, employees are exposed to the risk of suffering accidents at work, understood as any injury originating at work, from a violent cause, which may result in permanent (absolute or partial) or temporary inability to work.
absolute (with abstention from work for more than three days).
When accident events occur, Inail insurance intervenes, guaranteeing health and economic benefits.
The latter, in particular, take the form of an indemnity paid by the Institute to which a series of amounts payable to the company can be added, based on the provisions of the applied national collective bargaining agreement.
The management of accident events in the pay slip, already delicate in itself due to the presence of amounts owed by INAIL and also by the employer, becomes further complicated in the event of a relapse.
Let's analyze the issue in detail.
Inail injury relapse, complete guide Pay attention to the average global daily wage Pay attention to the shortage Pay attention to the methods of payment of the sums Pay attention to the average global daily wage For accident events that cause a state of temporary absolute incapacity for work, the remuneration is paid by: Dell the company for the day of the accident and the following three, in an amount equal to 100% of the average daily earnings; From the employer (so-called waiting period) from the 1st to the 3rd day following the event, in an amount equal to 60% of the average daily earnings (the national collective labor agreements however have the possibility of providing for more favorable conditions); of Inail from the 4th to the 90th day (even non-continuous), in an amount corresponding to 60% of the average daily wage; of Inail from the 91st day to recovery, in an amount equal to 75% of the average daily wage.
The collective agreements may also provide, during the periods borne by Inail, an integration into the company account of the sums owed by the Institute.
In these situations, the remuneration theoretically due if the employee had been regularly at work is calculated (or a percentage thereof) and the Inail allowance increased by the contributions paid by the employee is subtracted (so-called "grossisation").
The result of the subtraction expresses the integration due by the employer, to be paid in the pay slip.
It should be noted that the compensation paid by INAIL is paid, as anticipated, on the basis of a certain percentage of the average daily wage (RMG), calculated with reference to the last 15 days immediately preceding that of the accident.
In the event of a relapse (even months later) it is necessary to refer to the RMG applied for the previous event and, not vice versa, the "new" one relating to the 15 days preceding the relapse itself.
Let's take the example of the Caio employee who was absent due to injury from 1 May 2023 to 19 May 2023.
In this case the RMG is determined based on the 15 days (in April) immediately preceding the event.
Months later, Caio is affected by a relapse of the previous injury from 2 October 2023 to 13 October 2023.
In this situation, the calculation of the Inail compensation is based not on the 15 days before 2 October, but on the RMG of the event occurred in May, that, so to speak, calculated with regard to the fortnight preceding May 1st.
In light of what has just been described, the company, for fallout events, is required to carefully check the RMG calculated by the payroll software, making the necessary changes if necessary.
The latter can be applied by simply copying the RMG determined with reference to the previous event.
read also Accident at work, 3 mistakes to avoid in settlement Pay attention to the shortage As mentioned above, periods of absence due to injury are paid by INAIL starting from the 4th day following the event.
The previous days, in fact, are financially borne by the company.
For them, with the exception of any more favorable conditions envisaged by the individual collective bargaining agreements, employer account coverage is provided equal to: 100% of the average daily earnings, for the day of the accident; 60% of the average daily earnings, from the 1st to the 3rd day following the event (so-called waiting period).
However, what has been described applies exclusively to the first injury event.
In fact, periods of relapse and hospitalization for tests are excluded from the operation of the deficiency.
Consequently, the employer must verify the correct processing of the payslip by the payroll program, regarding those which are not only the amounts paid by INAIL but also by the company itself.

However, upon request to INAIL, the company can obtain authorization to advance the amounts in question into the paycheck.
In this case, the sums are paid by the Institute to the employer, using the bank details indicated by the latter in the accident report.
It may happen that the employer obtains Inail authorization between the first accident event and the relapse.
In these situations it is advisable to pay the utmost attention, since the payment method of the compensation indicated during the first event applies and not, on the contrary, the one used on the date on which the relapse occurs.
Let's take the example of the worker Mario absent due to injury from 1 May 2023 to 30 June 2023.
In this case the Inail compensation is paid directly to Mario.
Subsequently, in the month of August, the company forwards a request to the Institute for authorization to advance the allowance into the pay slip.
Request which was accepted on 31 August 2023.
From 1 October 2023 to 15 October 2023 Mario is absent due to a relapse of the May – June injury.
In this situation: The pay slip treatment of the absence must respect the payment method of the Inail allowance used for the first event (direct payment); Mario will have to expect the sums directly from the Institute and not, on the contrary, from the employer; Only the amounts that the applied Ccnl places on the employer, specifically the integration of the INAIL allowance, will be paid on the pay slip; The person in charge of payroll processing will have to consider, in the calculation of the integration, the "simulated" Inail allowance, subject to an adjustment to be made when the sums that the Institute has paid to Mario are known.
