Civilian invalids, the new rules: what changes and why
On November 3, the Council of Ministers approved in preliminary examination two implementing decrees of the framework law on disability.
Decrees that aim at the review and reorganization of current provisions on disability to guarantee disabled people the recognition of their condition and their civil and social rights, in compliance with the principles of self-determination and non-discrimination.
In the coming years there will be important innovations starting from the new method of ascertaining the condition of civil disability and the implementation of the individual, personalized and participatory life project of the person with disability.
The testing of these new procedures is scheduled for 2025.
Here's what will change.
The way in which civil disability is assessed is changing.
The Minister for Disabilities, Alessandra Locatelli, spoke of an epochal turning point and for the first time of a cultural change towards people with disabilities.
"The objective is to allow them to live and participate in social life according to a principle of equality", underlined the minister.
The two implementing decrees aim to reduce bureaucracy, streamline and simplify procedures.
The first innovation concerns the modification of the disability assessment procedures.
A reform that will start on an experimental basis in some areas of the country starting from January 2025 and will then officially become fully operational in 2026 when the assessment of civil disability will be entrusted to the INPS.
A way to unify the investigations.
If now people often find themselves with confirmed chronic degenerative pathologies having to repeat check-ups after 2-3 years, with the new decree this will no longer be the case.
As written «The certification of the condition of disability will be unified with the process of ascertaining civil disability, civil blindness, deafblindness, pupils with disabilities, and the elements useful for defining the condition of non-self-sufficiency.
The procedure will be activated by an introductory medical certificate." Therefore the only procedure managed by INPS.
Introduction to the life project Then the life project is introduced.
If previously people had to clash between different bodies for health, social-health or social needs, with the establishment of a single commission this will no longer be the case.
A single body that will decide together with the disabled person what he or she needs.
The second part of the decree regulates the establishment of a control room for determining the essential levels of services for people with disabilities.
In addition to the ministers responsible for the matter, this control room will include: a delegate from the Technical Commission for standard requirements; the President of the Conference of Regions; the President of the ANCI; the Presidents of the most representative Federations of the Associations in the field of disability.
The control room will be responsible for: carrying out an initial survey of the essential services of people with disabilities; propose guidelines for identifying the essential levels of performance and in particular recognizes the individual life plan as an essential level; verifies the methods of integrating the LEP with the essential levels of assistance (LEA); ensure the coordination and full effectiveness of the legislation regarding subsidies, incentives and facilities for people with disabilities, also with regard to the protections provided for by the legislation on civil disability.
The funds allocated for the implementation of the innovations are 350 million euros for 2026 to which another 85 million will be added each year.
