Study permits 2024, how many hours you are entitled to and when

Thanks to the study permits recognized by law no.
300 of 1970, the employee has the right to abstain from carrying out work activities in order to dedicate himself to his own training.
All without affecting your paycheck, as study permits are 100% paid.
However, there are very specific limits and rules, established both by the aforementioned law and by individual collective agreements.
For example, to benefit from study permits recognized during an employment relationship, these must be necessary for the achievement of legally recognized qualifications.
There is also a number of hours that must not be exceeded: in detail, it is 150 hours of right to study over 3 years, a threshold which in some cases can even be exceeded.
In this regard, given the importance of such a tool that allows you to enjoy more hours a day to dedicate to study, here is a complete guide for the worker with everything you need to know about it.
Study permits What are study permits Requirements How many hours are due Which courses are admitted Study permits for teachers and ATA: how to apply Other rights of student workers What are study permits Article 10 of law 300/1970 regulates the characteristics general information on study permits; for the methods of execution, however, the worker must refer to his national employment contract, as these may provide for more favorable treatment for the worker.
It is therefore in the Ccnl that the hours of leave that can be requested during the year are specified, as are the instructions for requesting.
The essential aspects of study permits, which we will explain in depth below, are: who can request them: student workers enrolled in legally recognized schools or in a professional training course; duration: depends on the Ccnl, but consolidated practice provides for 150 hours usable in 3 years; when to ask for them: they can only be used for attending courses or exams, and not for exam preparation.
Many student workers who want to raise not only their culture but also try to increase their rank in the company can take advantage of these study permits.
These are paid leaves; therefore, if you find yourself in the position of having to request leave for study purposes, your payday will not be taken away.
Requirements The right to use study permits is granted to the entire category of student workers.
Anyone who is enrolled and attends courses on a regular basis in primary and secondary schools is considered a student worker.
A "student worker" is also someone who attends professional courses, both at state and private bodies, authorized to issue legal qualifications.
If you fall into one of these categories, you will be able to request study permits to be absent from work.
Workers who have dropped out of course for various reasons can also take advantage of the study permit.
However, not all types of contracts allow you to apply for these study permits.
In fact, it can only be enjoyed on a permanent contract, whether full or part-time.
Fixed-term workers, those who have a project contract or those who work with a VAT number cannot benefit from the study permit.
In these cases, in fact, work has an end day and study permits cannot be issued when the worker does not have a stable contractual situation.
However, for workers with a fixed-term contract it is possible to benefit from paid leave only on the days in which they have to take an exam.
How many hours are up? The individual national collective agreements (Ccnl) establish how many hours are granted with the study permit.
In fact, each contract has specific clauses that regulate this point.
However, the legislation establishes that the maximum amount of hours for the right to study is 150 individual hours per year, granted to 3% of permanent workers in service.
Only if the worker must obtain a qualification in a compulsory school can the study permit increase up to 250 hours per year.
Therefore, if a professional course lasts 300 hours spread over 2 calendar years, then 300 hours of leave can be granted and permits can be requested for the 2 years of the course.
Which courses are admitted Study permits can only be used to attend courses that take place in conjunction with working hours.
We would like to clarify this fact, even if it seems rather banal, since it is not a given for all workers.
Therefore, to request and obtain these study permits, it is necessary to issue a certificate of attendance which certifies attendance at the course during working hours.
It is not possible in any way to request study permits for: evening courses, if the working hours do not coincide with the course time; online courses, since they do not have a mandatory attendance time and above all they do not involve travel.
It is therefore not possible to request permits of this type for the hours of study necessary to prepare for an exam.
For the same reason they are not applicable in cases where it is necessary to prepare for a public competition.
read also Permits for public competitions and exams, how many days are due and to whom Study permits for teachers and ATA: how to apply As regards teachers and ATA, the Education and Research contract establishes very precise rules for requesting study permits.
In detail, ATA teachers and staff who wish to request it must submit the application by November (according to the deadline indicated annually by the Ministry of Education and Merit) in order to benefit from the 150 hours of leave that can be used during the calendar year.
(so from January to December).
In the case of school staff, the request for study permits must be submitted to the secretariat of the school where you work; this will then forward it to the director of the Provincial School Office.
Why do teachers and ATA staff have until November to apply? This is because the Ccnl Scuola establishes that for each province the staff entitled to study permits cannot be more than 3% of the total staff in service.
For this reason, every year the USP publish a ranking based on the number of places available, so as to guarantee the transparency of the operation.
The other rights of student workers Student workers also have other rights, in addition to the possibility of requesting study permits.
First of all, they can request to be included in work shifts that facilitate course attendance and exam preparation.
Furthermore, they are not required to work overtime or cover shifts on holidays and rest days.
Daily permits may also be requested to take exams and defend the thesis.
In this case there are no time limits: permission can be taken for the whole day, provided that a certificate of actual presence at the exam or discussion of the thesis is presented.
