New Points-Based License System for Construction Workers

Starting from Tuesday, October 1st, a new points-based license system will be introduced, not for drivers but for construction workers.
This so-called construction points license is designed to ensure compliance with safety regulations in the workplace, distinguishing itself from conventional driving licenses.

Despite potential delays, the government is moving forward according to the established timeline set by decree law no.
19 of 2024.
The new license will serve as a critical tool for evaluating construction firms and self-employed workers, with significant consequences for non-compliance, including possible suspension of operations.

Who Needs the Points License?

The points-based license is mandatory for all construction companies, including sole proprietorships.
However, certain professionals, such as engineers, architects, or surveyors, who provide intellectual services, are exempt from this requirement.

It’s also important to note that foreign companies and self-employed workers operating within Italy must possess this license as well.

Requirements for the License

To obtain the license, applicants must fulfill specific criteria including:

  • Registration with the Chamber of Commerce, Industry, Handicraft and Agriculture;
  • Employers and workers must complete mandatory training obligations;
  • Possession of a valid Single Document of Contribution Regularity;
  • Preparation of a Risk Assessment Document where required;
  • Certification of Tax Regularity;
  • Designation of a responsible figure for safety measures.

How to Apply for the License

As of tomorrow, October 1st, applications can be submitted to the relevant Labor Inspectorate.
Current workers in construction can initially self-certify their compliance by emailing their declaration to: dichiarazionepatente@pec.ispettorato.gov.it.

The application may be submitted by the company’s legal representative or a designated individual.
For EU-based foreign firms, documentation equivalent to the Italian license must be recognized by local authorities.

Deadlines and Points Deduction

Applications must be submitted by October 31st.
From November 1st, it will be impossible to work without the license, and self-certifications will no longer be accepted.
Once issued, the license can be lost due to safety regulation violations, following a points deduction system that starts at 30 points.

Penalties for Non-Compliance

Companies operating without a license, or with fewer than 15 points, face administrative fines equivalent to 10% of the contract value, with a minimum fine of €6,000, along with a 6-month exclusion from public work contracts.
