The Christmas period effectively begins on Friday 8 December with the celebration of the Immaculate Conception.
A first holiday that will also have implications on the paycheck, especially for those who perform regular service on the holiday.
We remind you, in fact, that working during holidays is not mandatory as the legislation recognizes the right to paid leave: this means that the holiday is not actually a working holiday but is considered as such in the pay slip.
However, the employer and employee can agree so that the holiday is actually worked, with the obligation however to recognize a "bonus" in the pay slip, i.e.
an increase in the salary calculated on the basis of the indications provided by the relevant collective agreement.
It is the Ccnl, in fact, that determines the amount of the increase for holiday work, the same one that will be applied to those who work on Friday 8 December, as well as on Christmas and New Year's days.

December 8th on the pay slip: the reference context December 8th is the day of the Immaculate Conception, therefore it is a religious holiday recognized throughout Italy and which more generally kicks off the Christmas celebrations of the month of December.
Being a holiday recognized in all respects by current legislation, 8 December guarantees the worker the following rights: if it coincides with a midweek and working day, the employee can be absent from work while maintaining the right to remuneration; if it coincides with a non-working day (for example on the weekend, or on the employee's rest day), then the rules for unused holidays apply.
That is: you are entitled to a salary increase if it coincides with a Sunday, or an extra day of rest if it is midweek; if the employee, in agreement with the employer, nevertheless decides to carry out work, the latter is entitled to a higher daily wage than that expected on other working days.
In particular, this person is entitled to the normal salary plus the increase for overtime on holidays, or – if the contract provides for compensatory rest in the case of working on holidays – only the increase for work on holidays.
This year, December 8, 2023 falls on a Friday, making it a working weekday for most employees.
For the vast majority, therefore, it should be a holiday enjoyed, which is treated on the pay slip as if it were a normal working day.
But we know well that for some it is a period of rest, for others it can be a period of greater work: think for example of workers in the restaurant industry, who during the holiday period must guarantee greater commitment and presence in the workplace.
For these, therefore, December 8th should still be a working day, with the consequence, however, of a higher salary than that expected on other days.
December 8: difference between holidays enjoyed and not enjoyed.
As just seen, therefore, it is good to make a distinction between when the holiday is enjoyed and when it is not.
In most cases, in 2023 December 8th will consist of a public holiday enjoyed as it falls on a midweek.
But let's think about those who enjoy the day of rest on Friday, and who therefore would have stayed at home anyway.
For these, it will be a holiday not enjoyed, and therefore the consequences provided for by the law will be triggered.
In detail, article 5, paragraph 3, of law no.
260/1949 states the following: If the holiday falls on Sunday, the workers themselves will be entitled, in addition to the normal global de facto daily salary, including any accessory element, to an additional salary corresponding to the daily rate.
If the unused holiday falls on a Sunday, therefore, you will be entitled to a bonus on your paycheck.
But what happens when, as in the case of Friday 8 December, it coincides with a midweek? In this case it is necessary to look at what is established by the relevant collective agreement.
There are collective bargaining agreements, most of them, where for example the employee is granted an extra day of leave, accrued during the holiday not taken, to benefit from in case of need.
However, cases in which it is treated as a holiday not taken which falls on a Sunday are rare, where an additional day of work is therefore recognized in the pay slip.
8 December worked and not: how to calculate it on the pay slip Therefore, 8 December on the pay slip must be calculated depending on whether the worker is working or not.
The worker who does not work on December 8th will receive the ordinary salary on his paycheck, regardless of whether he is paid hourly or monthly.
The situation changes, however, for those who will have to work on 8 December: let's think of shop assistants, bartenders and waiters.
For these people, since they will have to work on a public holiday, the relevant national collective agreement provides for an increase on the ordinarily expected salary.
The increase for weekend work varies, however, depending on the national collective labor agreement applied.
For example, workers to whom the Ccnl Commerce is applied and who will work on December 8th are guaranteed an increase of 30%.
To give another example, in the Ccnl Multiservizi, that of cleaning workers so to speak, the increase is equal to 50%.
It also happens that the increase for holiday work can be replaced by subsequent extra rest.
In the Ccnl for employees of companies in the public sectors, collective and commercial catering establishments and tourism, however, the increase recognized for holidays is 20%.
What happens if I am sick on December 8th? The last doubt concerns workers absent due to illness during a public holiday.
What happens in that case? According to a consolidated orientation of jurisprudence, this is not suspended: the public holiday, therefore, is not considered and 8 December will still be considered a sick day.
